After 2002 the military rank of C-in-C was reserved to the President alone but it is still a military rank and subject to the UCMJ in extraordinary circumstances.


No, there were several commander-in-chiefs who USED to be in the military including George H. W. Bush, George Bush, Eisenhower, Nixon, Johnson, Truman, Kennedy and others, however all of them were retired when they were elected BECAUSE ACTIVE SERVICE MEMBERS CANNOT HOLD ELECTED OFFICE. However here's a link to the UCMJ. Please show me where it states the President or any member of the Executive, Cogress or the House is subject to it

The precedent for this kind of thing started with Woodrow Wilson who was incapacitated while in office and it was determined that his wife was effectively carrying out the duties of the President. The Secretary of War was informed of this situation and the net result was the resolution of an unConstitutional situation with an unConstitutional solution that saw the US temporarily ruled by a triumvirate of Mrs. Wilson, the Secretary of State, and the Secretary of War.


A scenario now addressed by the 25th Amendment which was adopted long after Wilson's term. Now the Vice President and and a majority of the cabinet can submit to Congress and the House that the President is unable to discharge the powers and duties of his office. If the military took action based on the above scenario it would be a coup.
