Well, if it was such a crime, you would think there would be a stampede of opposition members to report it, with all the hystrionics from them. I mean is was physical molestation, according to Peter VanLoan. You would think he would do his civic duty and report that. Or what's her face, that felt so violated she had to leave the chamber - again, you'd think for the sake of violated women everywhere she would rush down to the cop shop to report this.

We're not talking about witnessless hypotheticals. We're talking about a specific incident. One captured on video that garnered significant media and public attention. Enough attention that if a crime had taken place, charges would have been laid. But a crime didn't take place and, therefore, no charges were laid.

Even the CBC noted the incident as an assault...technically.

$1:
Ottawa lawyer Michael Spratt agreed, saying that while, technically, it's an assault, the legal system calls for discretion and restraint when it comes to applying that law so it would likely not be concerned with incidents as trivial as Trudeau's grabbing of Brown's arm.

I've merely repeated comments from actual lawyers, not pretend ones.

Then why'd you bother to post on the subject if have nothing to add and don't give a fuck what others who aren't lawyers have to say? You must have had a reason, something to compel you to type and then click submit.

I never said their (your lawyers') comments are wrong. They are, however, out of context and not part of the discussion between you and I. And they're not here to say "...and of course, for an assault to have occurred, there must be criminal intent", which both would surely say if we could ask them.

There are lots of things that meet the definition of assault under the criminal code that are not assaults, like tapping someone on the shoulder. Technically, that is the application of force without consent. So why are all the tappers and touchers in society not charged with assault? Because there is more to a crime than the act.

Trudeau did not commit assault. He didn't meet the minimum standard for his actions to have constituted a crime. If he had, he'd have been charged. So to continue to insist that Trudeau committed assault is INCORRECT. Just like when I tapped you on the shoulder I technically committed assault but did not have the minimum standard of criminal intent to warrant a charge or conviction.

But as you said, it makes no difference to you. You were just piping in to fling shit, like usual.

Anyone who would have pressed charges after that ridiculous incident would either be the biggest wuss imaginable or the kind of low-down crawler trying to score bucks in a lawsuit lotto.
